Terms and Conditions of Sale
This translation is provided for informational purposes only. In case of discrepancy, the French version prevails.
Article 1 - Purpose and provider identity
These general terms and conditions of sale (the "Terms") govern the contractual relationship between Blackmile and its clients for the booking and provision of chauffeured passenger transport services (VTC).
The provider is Blackmile SAS, a simplified joint-stock company with capital of 1,000 euros, registered office at 44 rue Rennequin, 75017 Paris, France, registered with the Paris Trade and Companies Register under number 920 589 440 (SIRET 414 659 276 00029), reachable at contact@blackmile.fr.
Article 2 - Booking and formation of the contract
Any booking is made via the website, the app, by phone, or by email. The client agrees to provide accurate information regarding the pickup address, destination, and desired time.
The booking is confirmed by a confirmation email including the ride details and the price. This confirmation constitutes the formation of the transport contract between the client and Blackmile.
Taxi rides (metered, regulated fare) remain available by phone or through a business account, outside the fixed pricing described in Article 3. Their specific conditions are communicated to the client at the time of booking.
Article 3 - Pricing
VTC ride prices are communicated to the client before booking confirmation. They constitute a fixed package including:
- • Transport to the agreed addresses
- • Any tolls
- • A complimentary waiting allowance: 15 minutes for a standard pickup, 30 minutes for a transfer from a train station, 60 minutes for a transfer from an airport
- • Water and on-board amenities
Beyond this allowance, waiting time is billed at the rate in force communicated at booking, charged separately after the ride through a secure payment link sent to the client. For hourly hire, each booked hour includes 40 km; beyond that, each kilometre is billed at the long-distance rate of the booked tier (€1.70 incl. VAT for a sedan, €2.38 for a van, €2.50 for First Class) and settled after the service in the same way, or added to the invoice for business accounts. Kilometres are those shown on the vehicle's odometer, recorded by the chauffeur at the start and end of the service; any excess is communicated to the client before being billed. Blackmile reserves the right to revise its pricing; any change applies to bookings made after the update, never to a ride already confirmed.
Article 4 - Cancellation and no-show
The client may cancel their booking under the following conditions:
- • More than 24h before the ride: free cancellation
- • Between 6h and 24h before: 50% of the invoiced amount
- • Less than 6h before: 100% of the invoiced amount
- • Cercle Blackmile members: shorter free cancellation periods depending on level, see Article 13
Blackmile reserves the right to cancel a ride in case of force majeure, with no compensation due by either party. If the client is absent at the pickup point, the driver informs Blackmile, who attempts to reach the client; absent contact within a reasonable time, the ride is deemed not honored by the client and billed under the same conditions as a cancellation made less than 6 hours in advance.
Article 5 - Driver status
Rides are carried out by drivers selected by Blackmile, holding the regulatory authorizations required to operate chauffeured passenger transport, whether they are Blackmile employees or partner drivers operating under their own independent status.
Whatever the status of the driver assigned to the ride, Blackmile remains automatically liable to the client for the proper performance of the booked transport service, whether it is carried out by Blackmile itself or by an independent partner driver, in accordance with Article L3142-3 of the French Transport Code applicable to booking intermediaries (centrales de réservation). This liability can only be excluded in case of fault by the client, an unforeseeable and insurmountable act of a third party unrelated to the service, or force majeure, under the conditions set out in Article 9.
Article 6 - Vehicle damage
The client is liable for any damage to the vehicle caused by themselves or by anyone accompanying them during the ride. Cleaning or repair costs are billed to the client on the basis of a flat fee of 200 euros (VAT included), settled under the terms set out in Article 7.
Article 7 - Payment
Payment is made by credit card at the time the booking is confirmed, through a secure payment page, or by invoice for business clients with a business account.
For card-paid bookings, the client is given a deadline to complete payment after the ride is confirmed. If payment is not made within this deadline, the booking is automatically cancelled, at no cost to the client.
For B2B clients, payment is due within 30 days from the invoice date, unless otherwise agreed.
Article 8 - Punctuality commitment
Blackmile measures the punctuality of its rides: a pickup is considered on time when it occurs within 5 minutes of the scheduled time. Blackmile commits to a punctuality rate of 95%, calculated across all of its rides.
This 95% commitment relates to the overall, measured performance of the service.
For any single ride, if the driver arrives at the pickup point more than 5 minutes after the agreed time, Blackmile deducts €2 per minute of delay from the ride price, starting from the sixth minute and up to the price of the ride. The arrival time taken into account is the one recorded by the driver in the Blackmile application. The deduction is applied by Blackmile within 24 hours of the ride: it is refunded to the client, or deducted from the invoice for business accounts.
This deduction does not apply when the delay results from an incorrect address or time provided by the client, nor in the external circumstances referred to in Article 9.
Article 9 - Liability
Blackmile commits to transporting the client under the best conditions of comfort and safety, including when the ride is carried out by an independent partner driver under the conditions of Article 5. Blackmile's liability is limited to direct damages resulting from proven fault.
Blackmile makes every effort to meet agreed schedules. In case of delay caused by unforeseeable circumstances beyond its control (exceptional traffic conditions, bad weather, strikes, a delayed flight or train for a transfer), Blackmile's liability shall not exceed the price of the booked ride.
Article 10 - No right of withdrawal
In accordance with Article L221-28 12° of the French Consumer Code, the right of withdrawal does not apply to passenger transport services provided on a specified date. The client therefore has no withdrawal period on bookings made; only the cancellation terms set out in Article 4 apply.
Article 11 - Claims
Any claim must be sent by email to contact@blackmile.fr within 7 days of the ride concerned. This contractual deadline does not deprive the client of any legal rights and deadlines otherwise applicable.
Article 12 - Consumer mediation
In accordance with Articles L611-1 et seq. of the French Consumer Code, any client acting as a consumer has the right to refer any unresolved dispute, free of charge, to a consumer mediator after a written claim submitted to contact@blackmile.fr. The competent mediator's details will be published on this page once Blackmile has registered with an approved consumer mediation body.
Article 13 - Loyalty Program and Cercle Blackmile
Blackmile offers a loyalty program reserved for individual clients (B2C). Each completed ride grants 1 loyalty point.
- • Upon accumulating 10 points, the client receives a free ride; the counter then resets to zero and free rides can be accumulated
- • The free ride can be used on a fixed-price ride of up to 20 km, booked at least 72 hours in advance, excluding hourly bookings, recurring rides and group bookings
- • The free ride does not expire: it remains available on the client's account until it is used
- • Loyalty points are neither transferable nor exchangeable for monetary value
- • Blackmile reserves the right to modify or suspend the loyalty program at any time, with 30 days' notice
- • Points earned remain valid in the event of program changes
Cercle Blackmile
In addition to the loyalty programme above, Blackmile offers private clients the Cercle Blackmile, whose benefits are services, not discounts.
- • The Cercle Blackmile is reserved for private clients. It has four levels: Member (from the first paid ride), Graphite (20 rides), Onyx (40 rides) and Obsidian (by Blackmile invitation only)
- • Completed and paid rides booked in a personal capacity count from the creation of the account. Free rides and rides booked on behalf of a company do not count
- • By derogation from Article 4, a Circle member may cancel online free of charge up to 12 hours before departure (Graphite), 6 hours (Onyx) or 2 hours (Obsidian). Within these periods, the conditions of Article 4 apply
- • The free waiting time for a standard pickup is extended to 20 minutes (Graphite), 30 minutes (Onyx) and 45 minutes (Obsidian), and for an airport pickup to 60, 90 and 120 minutes. Any free waiting time under Article 3 that is more favourable to the client still applies
- • Blackmile may grant a level to a client who holds an equivalent status in another programme, or to a person close to an Obsidian member designated by that member
- • Other level-related attentions (priority on peak days, usual chauffeur, complimentary treat) are offered subject to availability and are not an obligation of result
- • Circle benefits are services. They are neither transferable nor exchangeable for monetary value
- • Blackmile may change the Circle thresholds or benefits with 30 days' notice. A level already reached by a member is kept
Article 14 - Referral Program
Blackmile offers a referral program allowing existing clients to recommend the service to new users.
- • Each client has a unique, personal referral code
- • A referral is validated when the referred person, registered with their referrer's code, completes their first ride
- • Once the referral is validated, the referrer and the referred person each receive a free ride. The referrer can accumulate a maximum of 5 free rides through referrals, across all referred persons; an account can only be referred once
- • Free rides obtained through referral are subject to the same conditions of use as those of the loyalty program (20 km maximum, booked at least 72 hours in advance, excluding hourly bookings, recurring rides and group bookings) and do not expire
- • The referral code cannot be used by the referrer themselves
- • Blackmile may review a referral before granting rewards. Any fraud attempt (fake accounts, self-referral) will result in cancellation of rewards and may lead to account suspension
- • Blackmile reserves the right to modify the referral program's terms at any time, with 30 days' notice
Article 15 - Governing law and jurisdiction
These Terms are governed by French law. If the client acts as a consumer, they may bring proceedings before the court of their place of residence or the place where the service was performed, or use the mediation process set out in Article 12. If the client acts as a professional, any dispute falls under the exclusive jurisdiction of the courts of Paris.
